TORRINGTON COUNTY COURT, May 7.
Before John Tyrrell, Esq.
James Broadway v. John Copp. – The plaintiff is a hawker of brushes, having much the appearance of a gipsy; and the defendant is a mason, of Beaford. In February last the defendant lost his donkey, which enjoyed the same privileged vagrancy accorded to many other asses namely, of wandering about the roads, Defendant heard that some gipsies had fixed their tent in the vicinity of Beaford village; and as a scandal attaches to these “flowers of the forest” to the effect that they are not very squeamish over the tenth commandment, the mason of Beaford visited their encampment. There, sure enough, the fugitive donkey had taken up its quarters – willingly or otherwise: apparently as unconcerned about Mr. Copp as Mr. Copp was at that moment concerned about any other person’s donkey. The ownership was disputed: Copp vowed the donkey to be his “lost one,” and Broadway insisted that the claimant was labouring under a very strange hallucination. If the question could have been decided by words the victory would have been against Copp, who, however, called in the veritable poleceman. “The ass knoweth his master’s crib,” and this “legal luminary” at once suggested that the donkey should be taken to Beaford village, and then allowed to take its own course. This was done, and the animal halted as it came to the defendant’s door. This was regarded as proof positive; and the plaintiff was apprehended upon the charge of stealing the donkey. The case against Broadway was suspicious; but, conceiving the evidence insufficient, the Magistrates at Torrington dismissed the case. Whereupon the plaintiff brought a action for fifteen shillings against Copp, as damages for false imprisonment. These circumstances were unfolded at the April court, when the case was adjourned in consequence of the unavoidable absence of Mr. Lionel Bencraft, who was engaged by the defendant. Whether this fact struck terror into the soul of Broadway or not none other but Broadway himself can say; but the plaintiff did not now appear, and the case was struck off the list, his Honour allowing the defendant 20s. for expenses.
